Laws written by Congress such as the Clean Air Act, Clean Water Act, Safe Drinking Water Act, and other laws, provide the authority for EPA to write regulations. In most cases, New York State has adopted regulations that are as stringent as EPA's and the State has applied for and been given primacy for enforcement.
